Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Where's My Booking mobile application (the "Service") operated by Arthur Uberti Rolim ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. Use of the Service
1.1 Eligibility
You must be at least 13 years old to use this Service. By using the Service, you represent and warrant that you meet the eligibility requirement and have the legal capacity to enter into these Terms.
1.2 User Account
To use the Service, you may be required to create a user account through third-party authentication providers. You are responsible for maintaining the confidentiality of your account credentials and accept responsibility for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
1.3 Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
- In any way that violates any applicable federal, state, local, or international law or regulation
- To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation
- To impersonate or attempt to impersonate us, our employees, another user, or any other person or entity
- In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
- To upload, transmit, or process any content that contains viruses, malware, or other harmful code
- For any commercial purposes without our express written consent
1.4 Email Processing Service
By using our email processing feature, you acknowledge and agree that:
- You will only forward booking confirmation emails to our designated email addresses (@wheresmybooking.com domain)
- We do not access your personal email inbox or any email accounts you have not explicitly forwarded to us
- You are solely responsible for the accuracy and completeness of emails you choose to forward to us
- You have the legal right to share the contents of any emails you forward to our Service
2. Subscription and Billing
2.1 Free and Premium Plans
We offer both free and premium subscription plans. Free plans include limited monthly booking processing and feature access. Premium plans provide additional processing capacity and access to advanced features.
2.2 Payment Processing
All payments are processed through Stripe, Inc. ("Stripe"). By subscribing to premium features, you agree to Stripe's terms of service and authorize us to charge your selected payment method.
2.3 Billing and Renewals
- Premium subscriptions automatically renew at the end of each billing cycle unless canceled
- You may cancel your subscription at any time through your account settings
- Cancellations take effect at the end of the current billing period
- We do not provide refunds for partial billing periods
2.4 Changes to Pricing
We reserve the right to modify subscription pricing with at least 30 days' advance notice to existing subscribers. Price changes will not affect your current billing cycle.
3. Data Processing and Third-Party Services
3.1 AI Processing
We use OpenAI's services to process and extract information from your booking emails. By using the Service, you acknowledge that:
- Your email content may be processed by artificial intelligence systems
- AI processing may not always be 100% accurate, and you should verify all extracted information
- We are not responsible for any errors or omissions in AI-processed booking information
3.2 Data Storage
Your processed booking data is stored on servers provided by Supabase, Inc. We implement appropriate technical and organizational measures to protect your data, but cannot guarantee absolute security.
3.3 Third-Party Service Dependencies
Our Service relies on third-party providers including but not limited to OpenAI, Supabase, and Stripe. Service interruptions or changes to these third-party services may affect the availability or functionality of our Service. We are not responsible for third-party service disruptions.
4. Intellectual Property
4.1 Ownership
The Service and its original content, features, and functionality are and will remain the exclusive property of Arthur Uberti Rolim and its licensors. The Service is protected by copyright, trademark, and other laws.
4.2 License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your personal, non-commercial use.
4.3 User Data
We do not claim ownership of your booking information or personal data. However, you grant us a limited license to process, store, and display your data as necessary to provide the Service.
5. User Content and Booking Data
5.1 Your Responsibility
You are solely responsible for the accuracy and legality of any booking information or other content you provide through the Service. You warrant that:
- You have the legal right to share all booking information you provide
- All information you provide is accurate and not misleading
- You will not use the Service to process booking information belonging to others without proper authorization
5.2 Data Accuracy Disclaimer
While we strive to accurately process your booking information using AI technology, we make no warranties about the accuracy, completeness, or reliability of extracted booking data. You are responsible for verifying all processed information before relying on it for travel or other purposes.
6. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, store, and disclose information about you. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.
6.1 International Data Transfers
Your data may be transferred to and processed in countries other than your country of residence, including the United States. These countries may have data protection laws that are different from the laws of your country.
7. Termination
7.1 Termination by Us
We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms or engage in conduct that we determine is harmful to other users or our business.
7.2 Termination by You
You may terminate your account at any time by contacting us or using account deletion features within the Service.
7.3 Effect of Termination
Upon termination, your right to use the Service will cease immediately. We may delete your account and all associated data, though we may retain certain information as required by law or for legitimate business purposes.
8. Disclaimers and Limitation of Liability
8.1 Service Disclaimer
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8.2 Booking Information Disclaimer
WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY BOOKING INFORMATION PROCESSED THROUGH THE SERVICE. YOU USE ALL PROCESSED BOOKING INFORMATION AT YOUR OWN RISK.
8.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
8.4 Travel-Related Disclaimers
WE ARE NOT RESPONSIBLE FOR ANY MISSED FLIGHTS, HOTEL RESERVATIONS, OR OTHER TRAVEL ARRANGEMENTS RESULTING FROM INACCURATE OR INCOMPLETE BOOKING INFORMATION PROCESSED BY OUR SERVICE. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ALL TRAVEL DETAILS WITH RELEVANT PROVIDERS.
9. Indemnification
You agree to indemnify, defend, and hold harmless Arthur Uberti Rolim from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service or violation of these Terms.
10. Governing Law and Dispute Resolution
10.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
10.2 Dispute Resolution
Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in English in Delaware, United States.
11. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
12. General Provisions
12.1 Entire Agreement
These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
12.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
12.3 Waiver
Our failure to enforce any provision of these Terms shall not be deemed a waiver of future enforcement of that or any other provision.
